These Terms of Service (“Terms”) explain your rights and responsibilities when using ur website, purchasing our products, or interacting with our services. By using our site or buying from us, you agree to these Terms so please read these Terms of Service carefully before accessing or using our website..
1. Who We Are
Fizzies is an Australian small business creating imaginative, hands-on play products and kits for children. Our products are designed to spark creativity, outdoor play, and magical adventures.
2. Using Our Website
a) Permissible Use
Our products are intended for personal enjoyment and use as described. Businesses wishing to use our products commercially or as part of a service must obtain written permission from Fizzies and agree to our wholesale or business terms.

Infringe on our intellectual property rights through copying or derivative works;
Use our site or content for unlawful purposes, harassment, discrimination, or harmful conduct;

Violation of these prohibitions may result in immediate termination of service and/or legal action.

3. Product Information
We aim to display product details and images accurately. However:
Colours and finishes may vary slightly due to screens, lighting, or photography edits
Product availability, descriptions, pricing, or promotions may change without notice;
Occasional errors, omissions, or typos may occur, and we reserve the right to correct them and cancel any orders if necessary.
4. Orders, Payment & Pricing
All orders are subject to acceptance and availability. Prices are in Australian Dollars (AUD) and may change without notice.
Payment is processed securely via our third-party providers;
You must provide accurate billing and shipping information;
We may cancel or refuse orders at our discretion, for example in cases of suspected fraud.
We reserve the right to refuse service to anyone for any reason at any time.
5. Shipping & Delivery
We ship within Australia unless otherwise specified. Shipping costs and estimated delivery times are shown at checkout.
Delivery times are estimates and may vary;
Fizzies is not responsible for delays caused by carriers or incorrect addresses;
We are not liable for parcels marked as delivered by the carrier but lost thereafter.
6. Returns & Refunds
We want you to love your Fizzies kits! If your item is faulty or damaged:
Contact us at jess@fizzies.com.au within 7 days of delivery;
Include your order number, a description of the issue, and photos of the damaged items
We will replace or refund items in line with Australian Consumer Law.
Change-of-mind returns are not accepted due to the handmade and consumable nature of our products.
7. Product Use &Safety
Fizzies kits are designed for imaginative play for children aged 5+. By purchasing or using our products, you acknowledge and agree that:
Contains small parts that are a choking hazard, not suitable for children under 3 years old.
Adult supervision is required;
Ingredients are non-toxic but not edible;
Check ingredients for allergies or sensitivities;
We are not responsible for misuse or unsupervised play.
Particiapnts must follow the instructions provided;
Fizzies is not responsible for any injuries, accidents, or incidents that may occur during the use of our kits, including but not limited to cuts, burns, allergic reactions, insect bites, falls, or other hazards;
You use our products at your own risk and are responsible for ensuring a safe play environment.
Nothing in this clause limits your rights under Australian Consumer Law, including the right to remedies for products that are faulty or unsafe.
8. Intellectual Property
All content, designs, images, logos, and text on our site or in our kits are owned by Fizzies.
You may not copy, reproduce, or use our materials without written permission;
Products are for personal enjoyment unless written permission is granted for commercial use;
Unauthorised reselling, modification, or commercial use is prohibited.
9. Promotions & Giveaways
From time to time, Fizzies may run promotions or giveaways:
Open to Australian residents unless stated otherwise;
Entry rules and deadlines will be clearly listed;
Winners are chosen at random and contacted via jess@fizzies.com.au or @fizzies;
Prizes are not redeemable for cash;
Giveaways are not sponsored, endorsed, or administered by Instagram or any platform;
By entering, you may receive occasional updates or offers from Fizzies (you can unsubscribe at any time).
10. Limitation of Liability
Fizzies is not liable for any indirect, incidental, or consequential loss resulting from use of our website or products.
Our total liability is limited to the purchase price of the product;
This does not affect your rights under Australian Consumer Law.
11. Indemnity
You agree to hold Fizzies and our staff harmless from any claims, damages, or legal costs arising from your breach of these Terms or unlawful use of our products or website.
12. Termination
We may suspend or terminate access to our website or services if these Terms are breached.
You may stop using our services at any time. Obligations incurred before termination remain in effect.
13. Governing Law
These Terms are governed by the laws of Western Australia, and any disputes will be subject to the jurisdiction of its courts.
